Did anyone catch that we have ANOTHER ballot measure circulating

From the Secretary of State's website:
Referred law: An Act to provide for the mandatory withdrawal of blood or other bodily substances subsequent to arrest for driving while under influence. View full text of petition
This measure is being circulated by a Kent Hazelrigg, a House mover from Rapid City. Since I'm not familiar with the name from political circles, I'm sure there's a pretty good story out there on why he's doing it.

California has been doing that for a very long time.

However a bunch of DUI convictions were recently overturned in San Diego, (where we're rather fond of our corruption), when it turned out people drawing blood weren't certified to do so.

I would never sign this petition and hope few do. Anything we can do to get DUI'ers off the road is fine with me.

And if Bonnie's comment is a concern, it isn't that hard to get certified to draw blood. Did you know that anyone off the street basically can get a job as a phlebotomist (blood drawer) in a hospital with very little on the job training. Give the police officers a crash course in drawing blood and they'd be certified. Problem solved.

If a person wants to drink, that's his/her business. If he wants to get behind the wheel of a car afterwards, that's everybody else's business as he has just become a lethal weapon of possible mass destruction.

Nonnie, I'm not sure you understand this petition. It is to help get drunks off the roads. Right now they can refuse to submit to the blood test to get an accurate BAC. This would make it mandatory for suspected drunk drivers.

Yes, and do some searching and you'll find in wisconsin, taser's are ok to subdue DUI suspects to take blood. In Florida, I believe, DUI offenders have been suffocated to death by police trying to take blood samples. I'm sure we won't have a problem in SD though. What's Next.

My mistake then, Anonymous. I thought the legislature had passed the bill requiring this (know they considered it) and I guess I thought this was to repeal that law. Anyway, my mistake. If this petition is to mandate drawing blood from suspected DUI arrests, then I would most defnitely sign it. Where do I get a petition??

Nonnie, you had it right. The legislature passed this law. Now someone's trying to get signatures to refer it to the voters, ala the abortion bill.

Is it a requirement that the address be their residence ? on the petition where it says residence ?

I notice this from time to time on many petitions, the sposonsor uses their business address or other instead of where they live. PO boxes and such, just curious

The Legislature did pass this law as shown if you click on the "View Full Text of Petition." This law will go into effect on 7/1/06 unless it is referred to a vote by enough (too many) voters signing this petition.

If you like to drive while intoxicated you should sign this petition, otherwise I would think all others would oppose this petition.

I wonder how many DUI arrests Hazelrigg has and how many he got away with because he refused to give blood and the state didn't go to trial for fear of losing at trial without the blood evidence.
